1. What happens if you don’t have the deed?

If the house was inherited but the deed is not in your name, you legally cannot sell it yet. Even if you live there or it’s vacant, you first need to go through a succession process.

2. Testamentary or Intestate Succession Process

You must begin this process before a judge or a notary, depending on whether a will exists:

  • If there is a will and all heirs agree → you can do it through a notary.
  • If there is no will or there is a dispute → it must go through a judge.

Once the process is completed, you can register the property in your name with the Public Registry of Property.

3. Registration with the Public Registry of Property (RPP)
